1. Agreement to these Terms
These Terms of Use (“Terms”) are a legally binding agreement between you and Fidelity Speech and Voice Therapy, Inc., a California corporation (“Fidelity,” “we,” “us,” or “our”). They govern your access to and use of fidelityspeech.com and any related pages, content, interactive tools, digital products, courses, downloads, events, and services offered through it (together, the “Site”). By accessing or using the Site, buying a product, or registering for an event, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.
2. Eligibility
The Site is intended for adults 18 or older, including educators, school and program staff, and parents or legal guardians. It is not directed to children under 13, and we do not knowingly collect personal information from them. If you use the Site on behalf of a school, district, or organization, you represent that you are authorized to bind that entity to these Terms.
3. Educational purpose; no professional relationship
Content on the Site, including articles, interactive models, guides, courses, and downloads, is provided for general educational and informational purposes only. It is not medical, clinical, diagnostic, therapeutic, or legal advice. It is not a substitute for an individualized evaluation by a qualified, licensed professional. No clinician–client, therapist–patient, or other professional relationship is created by your use of the Site, a discovery call, workshop attendance, or the purchase of a digital product. Any such relationship exists only under a separate written agreement signed by Fidelity. Never disregard professional advice or delay seeking it because of something you read on the Site. In an emergency, call 911.
4. Intellectual property
All content on the Site, including text, curriculum, frameworks, lesson plans, graphics, logos, videos, audio, course materials, and downloads (“Fidelity Content”), is owned by Fidelity or its licensors. It is protected by United States and international copyright, trademark, and other intellectual property laws. “Fidelity Speech and Voice Therapy,” the Fidelity logo, and related names are trademarks of Fidelity. Except as expressly permitted in Section 5, you may not copy, reproduce, distribute, publicly display, modify, create derivative works from, sell, license, or otherwise exploit any Fidelity Content without our prior written permission. Third-party trademarks and materials referenced on the Site belong to their respective owners, and references do not imply affiliation or endorsement.
5. Digital products, courses, and downloads: limited license
When you buy or access a digital product (for example, a guide, course, template, or download), Fidelity grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license. You may use that product solely for your own personal, educational, or internal professional use, subject to these Terms. - Individual license: one purchase covers one user. You may not share login credentials or distribute files to others. - School and organization licenses: use by multiple staff members, or across a school, district, or organization, requires a separate group or site license. - Prohibited uses: you may not resell, redistribute, publicly post, upload to shared drives or websites, use in paid trainings or products, or remove copyright notices from any Fidelity Content. - Classroom use: educators who purchased a product may print or display materials for students in their own classroom, unless the product says otherwise. We may terminate your license and access, without refund, if you violate these Terms.
6. Purchases, payment, and refunds
Prices are listed in U.S. dollars and may change at any time before purchase. Payments are processed by our third-party payment processors (for example, Squarespace Commerce and PayPal). We do not store full payment card numbers. - Digital products and downloads: because digital products are delivered immediately, all sales are final once the product has been accessed or downloaded, except where required by law. [Option to choose: “Refund requests made within [7] days of purchase, before the product has been downloaded or accessed, will be honored.”] - Courses: [Choose one: “Refund requests made within [7] days of purchase and before [20]% of course content is completed will be honored,” or “All course sales are final.”] - Live workshops and events: [Cancellation terms, e.g., full refund up to [14] days before the event; credit toward a future event after that; no refund for no-shows.] If Fidelity cancels an event, you will receive a full refund or credit. - Physical books (e.g., ABCs of Belize): [Return terms for damaged or defective items, timeframe, shipping costs.] - School and organization contracts: payment, cancellation, and refund terms are set by the signed agreement or invoice, which governs if it conflicts with these Terms.
7. Use of AI tools in creating content
Some Fidelity Content may be drafted, organized, or edited with help from artificial-intelligence tools. All Fidelity Content reflects the original ideas, professional expertise, and editorial judgment of Fidelia Schnarr, M.S., CCC-SLP, who reviews and approves it before publication. Fidelity’s ownership rights under Section 4 extend to its original, human-authored contributions to the fullest extent permitted by law.
8. Acceptable use
You agree not to: (a) use the Site for any unlawful purpose; (b) upload or send another person’s confidential information, including a child’s health information, education records, or full name, through Site forms; (c) attempt to gain unauthorized access to the Site or its systems; (d) scrape, harvest, or data-mine the Site; (e) use Fidelity Content to train artificial-intelligence or machine-learning models without written permission; (f) interfere with the Site’s operation; or (g) impersonate any person or misrepresent your affiliation.
9. Workshops, events, and recordings
Participation in Fidelity workshops and events is also governed by our Photo, Video & Recording Policy. You may not record any Fidelity workshop, training, coaching session, or event (audio, video, or screen capture) without Fidelity’s prior written consent.
10. User submissions
If you send us comments, testimonials, or feedback, you grant Fidelity a non-exclusive, royalty-free, worldwide, perpetual license to use them to operate and improve our services. We will not publish your name or a testimonial attributed to you without your written permission.
11. Third-party links and services
The Site may link to third-party websites, research articles, form and scheduling tools (e.g., Google Forms), and payment processors. Fidelity does not control and is not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.
12. Disclaimer of warranties
THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FIDELITY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY CONTENT, PRODUCT, OR PROGRAM WILL PRODUCE ANY PARTICULAR EDUCATIONAL, ACADEMIC, READING, LANGUAGE, OR OTHER OUTCOME FOR ANY CHILD, CLASSROOM, OR ORGANIZATION.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FIDELITY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY CONTENT, PRODUCT, OR SERVICE. FIDELITY’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FIDELITY FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless Fidelity and its officers, directors, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: your violation of these Terms; your misuse of the Site or Fidelity Content; or your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. 16. Changes; severability; entire agreement
We may update these Terms at any time by posting a revised version with a new “Last updated” date. Your continued use of the Site after changes are posted means you accept them. If any provision is found unenforceable, the remaining provisions stay in effect. These Terms, the Privacy Policy, and any signed written agreement with Fidelity are the entire agreement between you and Fidelity about the Site.
